Chai's End User License Agreement, updated 28 July 2026, grants Chai Research Corp. an “unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free” license to “host, use copy, reproduce, disclose, sell, resell, publish” your contributions, including your name, image and voice, for any purpose including commercial advertising. Its privacy policy, updated 12 October 2026, says “We use personal data derived from your in-app conversations with chatbots to enhance and fine tune” its models after identifiers are removed, and keeps data for up to five years after you delete your account.

Mozilla's Privacy Not Included team gave Chai their warning label on 7 February 2024. At the time its privacy policy dated from March 2021 and did not mention how chat contents are handled, the EULA already carried the “sell, resell” license, and Mozilla could not confirm the app meets its Minimum Security Standards.

In March 2023 Euronews and Vice reported that a Belgian father in his thirties died by suicide after six weeks of conversations with a Chai chatbot called Eliza. Co-founder William Beauchamp said “a crisis intervention feature was implemented into the app.” Chai's safety page now states “Every user message is scanned in real time for self-harm content” and that the app is an 18+ service.
